Posting theories on missing N.S. kids online may lead to legal action, warns a lawyer. Stick to facts and trusted sources, RCMP urges.

As the disappearance of siblings Lilly and Jack Sullivan grips the nation, Canadian authorities and legal experts are issuing a stern warning: speculative and accusatory content posted online could result in legal repercussions.

What Happened in Lansdowne Station?

Lilly and Jack, aged six and four, were reported missing from their home on Gairloch Road in Lansdowne Station, Nova Scotia, on May 2. The RCMP initially stated that the children were believed to have wandered off. Since then, public interest has surged, leading to a wave of social media speculation—including unfounded claims about family involvement and amateur video analyses.

A Legal Perspective: Defamation, Harassment, and Cyber Law

Halifax lawyer Allison Harris, who previously represented the family of another missing child, says many online posts mimic the damaging patterns seen in earlier cases. She noted a rise in anonymous accounts, manipulated images, and harsh accusations. In similar cases, families have been subjected to online harassment and misinformation within hours of reporting a child missing.

Harris warns that such behaviour may cross legal lines. “If it rises to the level of criminal harassment or threats, police can intervene,” she explained. Civil action under Nova Scotia’s Intimate Images and Cyber-Protection Act also offers a path for victims to pursue justice. Courts may issue protection orders or demand the removal of harmful content.

Misinformation’s Impact on Investigations

Beyond legal risks, misinformation burdens law enforcement. Harris emphasized that investigators must track every tip—even if it’s based on falsehoods—which diverts resources from credible leads. “It just leaves a lot more for the police staff to wade through,” she said.

To date, the RCMP has received over 180 public tips. Yet little information has been confirmed, and authorities remain tight-lipped, a decision they say is necessary to protect the integrity of the investigation.

RCMP: Trust Only Verified Sources

RCMP spokesperson Cpl. Guillaume Tremblay cautioned the public against drawing conclusions based on online speculation. “It’s important to rely on trusted sources,” he said, encouraging the use of verified RCMP social media accounts and reputable news outlets for updates.

Ongoing Search and Family Statements

Search teams covered 5.5 square kilometres of rugged, wooded terrain using dogs, drones, and helicopters. Despite the extensive effort, RCMP scaled back their search, citing a “very low” likelihood the children remain alive.

Family members have offered limited comments. The children’s stepfather said they continue to support investigators on-site, while their mother has declined media interaction under RCMP advice. Her family expressed hope for a positive outcome.

Legal Tools for Online Victims

Harris noted victims of harmful posts can seek a cyber protection order through the Supreme Court. Judges may also award financial damages depending on the extent of harm caused.

The message from authorities and legal professionals is clear: speculation can cause real harm—and may come at a legal cost.
